Jack Litwak Speaks With News 12 About The Impact of Covid-19 on People Accused of Committing Crimes – What Attorneys Should Be Doing to Protect Them
Covid-19 and the impacts on those awaiting trial
Weeks ago, COVID-19 cases in Arizona were in the double digits. Today we have 1,157 cases with 20 deaths. Jails are an absolute breeding ground for this virus due to increased crowding, delays in medical evaluation and treatment, rationed access to soap, water, and clean laundry, insufficient infection-control expertise, and prohibitions against the use of proven harm-reduction tools. When this hits Arizona Jails it is going to explode see Legal Aid NYC Infection Stats. The result will be devastating to a population of high risk individuals who are presumed innocent, many of which suffer from underlying conditions.
Mr. Litwak, and his colleague Richard Gaxiola, spoke with 12 news to highlight the importance of motions to modify release conditions to protect their clients, jail staff, attorneys, and the community.
For those accused of violent offenses, a case by case approach should be taken to explore alternative options to protect the community. For all other cases, we ask the court to follow states like New Jersey and release people sitting in jails. See NJ Consent Order.
